SoMind ("we", "us", or "our") is committed to safeguarding the Personal Information we collect when you use our Services. This Privacy Policy explains what information we process, how we use it, when we disclose it, and your rights regarding your information.
2. Information We Process
2.1 Information Provided by You: We may process information you provide directly, such as your name, email address, age, sign-in information, account settings, support inquiries, AI chat messages, and cycle records you choose to enter.
2.2 Wellness Data: When you connect a supported consumer wearable device, we may process wellness trend data synced from the device, including sleep data, activity data, heart rate data, and related wellness summaries.
2.3 AI Interaction Data: If you choose to use AI features and grant permission for AI Data Use, we may process your questions or messages, selected wellness trend data, sleep summaries, activity summaries, heart rate trends, cycle records you entered, and basic app context necessary to generate AI responses.
2.4 Information Collected Automatically: We may collect technical data such as device model, operating system, IP address, app version, unique identifiers, usage data, feature interactions, crash logs, and performance logs.
2.5 Third-Party Sources: We may use third-party SDKs and service providers, including Firebase and Google Analytics, to measure app performance, engagement, and reliability.
3. How We Use Your Information
3.1 Service Delivery: Account management, transaction processing, and wellness trend display.
3.2 Communication: Critical service updates, security alerts, and administrative messages.
3.3 Marketing: Promotional updates. You may opt out by contacting help@femometer.com.
3.4 Analytics: Researching trends and usage patterns to improve product quality and user experience.
3.5 Security & Legal: Fraud prevention, enforcement of Terms of Service, and compliance with applicable laws.
3.6 AI Features: If you enable AI Data Use, we may use your questions or messages, selected wellness trend data, sleep summaries, activity summaries, heart rate trends, cycle records you entered, and basic app context to generate AI summaries and responses through the OpenAI API. AI Data Use is optional and can be disabled at any time in Settings > AI & Data Use.
4. Disclosure of Information
4.1 Service Providers: We may share limited information with service providers that help us operate the app, including cloud hosting providers, analytics providers, customer support tools, and payment processors where applicable.
4.2 Third-Party AI Service Provider: SoMind uses the OpenAI API to generate AI summaries and responses. Information is only sent when you choose to use AI features and grant permission for AI Data Use. Before transmission, we remove or exclude direct personal identifiers whenever possible and limit the data shared to what is necessary to generate the AI response. We do not send your name, email address, phone number, precise location, payment information, password, or Bluetooth device identifiers to OpenAI for AI responses.
4.3 Third-Party Protection: We require service providers that process information on our behalf to maintain privacy and security safeguards that are equivalent to those described in this Privacy Policy.
4.4 Legal Requirements: We may disclose information when required by applicable laws, legal processes, or enforceable government requests.
4.5 Business Transfers: Information may be transferred as part of a merger, acquisition, financing, reorganization, or sale of assets.
5. Your Rights and Choices
5.1 Access & Correction: You may access or update certain account information through the app settings.
5.2 AI Data Use Permission: AI Data Use is optional. You may enable or disable it at any time in Settings > AI & Data Use. If disabled, SoMind will not send your personal data to OpenAI, and AI-generated responses will not be available.
5.3 Account Deletion: You may delete your account at any time within the app or by contacting us.
5.4 California Privacy Rights (CCPA): California residents may have rights to access, delete, and opt out of certain information-sharing practices.
6. International Data Transfers
Information may be processed on servers located outside your home country. We implement industry-standard security measures, including SSL/TLS encryption, to protect your information.
7. Children's Privacy
The Services are not intended for children under the age of 13. If you believe unauthorized information from a child has been collected, please contact help@femometer.com.
8. Data Retention and Deletion
We retain your Personal Information only for as long as necessary to provide the Services, maintain your account, operate app features, comply with legal obligations, resolve disputes, enforce our agreements, and protect the security and integrity of the Services.
In general, we retain different categories of data as follows:
Account information, such as your email address, sign-in identifiers, and basic profile information, is retained while your account is active. If you delete your account, we will delete or anonymize this information within 30 days, unless a longer retention period is required or permitted by law. Health and well-being data, such as sleep, activity, heart rate, HRV, SpO2, temperature trends, stress, mood, and related wellness records, is retained while your account is active so we can provide historical trends, insights, AI features, and other app services. If you delete your account or request deletion, we will delete or anonymize this data within 30 days, unless a longer retention period is required or permitted by law. AI interaction data, such as chat history, prompts, responses, and related context, is retained while your account is active to provide conversation history, app functionality, quality improvement, and safety support. If you delete your account or request deletion, we will delete or anonymize this data within 30 days, unless a longer retention period is required or permitted by law. Device, technical, analytics, and usage data, such as device model, operating system, IP address, app events, crash logs, diagnostics, and performance logs, is generally retained for up to 24 months for security, analytics, troubleshooting, and service improvement purposes. Support communications, such as emails or customer service requests, may be retained for up to 3 years after the issue is resolved, unless a longer retention period is required for legal, regulatory, tax, accounting, dispute resolution, or security purposes.
Some information may be retained for longer where necessary to comply with legal obligations, prevent fraud or abuse, resolve disputes, enforce our agreements, maintain security, or protect our legal rights.
Backup copies and system logs may remain in our backup systems for up to 90 days before being securely deleted or overwritten according to our standard backup retention practices.
